This Privacy Policy explains what personal information is collected by Legend Trading Inc. (“Legend Trading US”) (“we”, “us”, “Legend”), why we collect it, and how we treat your information. This Privacy Policy applies to you, along with Legend Terms of UseTerms of Use, whenever you access the Legend website and/or access any of the services provided by Legend, whether directly or through a third party digital currency service provider (“Third Party Platform”). By visiting, accessing, or using Legend, you have indicated that you are at least eighteen (18) years old, have the legal capacity to consent to this Privacy Policy, and to agree to be bound by the policies and practices of this Privacy Policy in their entirety. If you are younger than eighteen (18) years of age, you may not create an account or otherwise access Legend’s products and services.
As used herein, “Digital Currency” means a digital asset (also called a “cryptocurrency,” “virtual currency”), such as, but not limited, bitcoin or ether, which is based on a cryptographic protocol(s) of an electronic system that may be (i) centralized or decentralized, (ii) proprietary or open-source, and (iii) used as a medium of exchange and/or store of value.
We are required to collect certain personal information about you for various reasons including to create your account, fulfil our contractual obligations to you, communicate with you, improve our products and services, detect and monitor fraud on our platform and otherwise comply with our contractual and legal obligations to others. By accepting this Privacy Policy, you expressly consent to Legend collecting the following types of personal information about you:
Information used to identify you such as your full name, date of birth, nationality, identity number or social security number, email address, phone number and address as well as any supporting documentation such as your passport, identity card and drivers license. For institutional users, information such as your institution’s legal name, Employer Identification Number (“EIN”) or comparable identification number, identity information relating to your account representative and beneficial owners, business address, entity formation documentation, contact information and any other information we may reasonably require to open an account for you and meet our obligations in relation to the operating of that account.
Information you provide to us when signing up for an account such as an image or video of your face which, using certain image recognition software, is used to verify your identity.
Other types of information which may be needed to open and operate your account such as information about your source of funds, bank account information, loan accounts, investment accounts, and credit and/or debit card information.
Information that is automatically collected about your device (such as, but not limited to, hardware, operating system, browser, etc.) and usage (see cookie section below).
Information that is automatically collected via analytics systems providers to determine your location, including your IP address and/or domain name and any external page that referred you to us.
Information that is generated by your use of Legend that is automatically collected and stored in our server logs. This may include, but is not limited to, device-specific information, location information, system activity and any internal and external information related to Legend pages that you visit.
Information that is generated by your trading activity including, but not limited to trading activity. digital currency wallet addresses, and ownership details relating to the digital wallet address.
Information that you provide to us in correspondence, including opening an application, and with respect to ongoing customer support.
Information available via a public blockchain and blockchain analytics tools, such as wallet balance and transaction history.
Including data about your employer, in cases where you have provided us with your pay stub or tax form information.
The personal information outlined above is collected in various ways such as:
From you, when you create a Legend Trading account directly with us;
From you and/or a third party digital asset service provider (“Third Party Platform”) when you make use of the Legend Pay product on the Third Party Platform;
From certain other third party service providers and public registries, which we use to verify your identity and process your transactions. These third party providers include but are not limited to:
Legend Trading uses Plaid Inc. (“Plaid”) to gather End User’s data from financial institutions. By using our service, you expressly consent to the collection and processing of this personal information and you grant Legend and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy .
Legend uses Veriff (veriff.com) for verifying user identification documents and screening users in accordance with our anti-money laundering and counter-terrorist financing obligations. By using our service, you expressly consent to the collection of this personal information and you (including biometric information) and to the storage, retention, use, and disclosure of this information in accordance with the Veriff Privacy Policy .
Please note that, if you withdraw your consent relating to the collection of your personal information using any of these methods, you will no longer be able to use Legend. In this case, please contact us about closing your account.
When you access Legend, Legend may make use of the standard practice of placing tiny data files called cookies, flash cookies, pixel tags, or other tracking tools (herein, “Cookies”) on your computer or other devices used to visit Legend. Cookies are small bits of information that are automatically stored on the web browser of your device that can be retrieved by us. The type of information we collect includes, but is not limited to, uniquely identifying visitor information and information related to your usage preferences. Legend use these technologies to help us recognize you as a user, collect information about your use of Legend to better customize our services and content for you, and collect information about your computer or other access devices to (i) ensure compliance with our BSA/AML Program and (ii) ensure that your account security has not been compromised by detecting irregular or suspicious account activities. By using Legend, you acknowledge and agree that we may collect and/or transmit any data collected to our third-party service providers, such as analytics providers, which may also make use of such technologies described above.
Please note that if you block or delete cookies you will not be able to use some or all of Legend’s website and/or services. If you do not consent to the placing of Cookies on your device, please do not visit, access, or use Legend.
Legend will only use your personal information for the purposes outlined in this Privacy Policy. Sometimes this requires that we share your personal information with certain third parties, such as:
Third party identity verification services to confirm your identity by comparing the information you provide us to public records and other third-party databases;
Third party fraud detection and other types of services to monitor fraud and other types of prohibited behaviors;
Service providers under contract and affiliated entities who help with parts of our business operations such as payment processing, marketing, technology services, compliance services and any other necessary operations to enable our services;
Financial institutions with which we partner to process your transactions and otherwise enable our services;
Third party digital asset service providers, where executing a transaction on your behalf to or from another third party digital asset service provider (if applicable);
Companies or other entities in the event of a joint venture, merger, acquisition or sale of the Legend business for any reason;
Law enforcement agencies, regulatory agencies or other authorized officials for example when: (i) we are required to report customer information in terms of our regulatory obligations, (ii) we are compelled to do so by a subpoena, court order, or similar legal procedure; (iii) we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate violations of our User Agreement; or (iv) otherwise required by law; and Other third parties with your consent or direction .
The above third-party and affiliate service providers are subject to confidentiality and security obligations.
You should be aware that above third party and affiliate service providers may be located outside of the jurisdiction in which you reside. By accepting this Privacy Policy, you expressly consent to any such cross-border transfer, storage and processing of your personal information for the purposes outlined in this Privacy Policy.
Subject to applicable laws and regulations, we may from time to time send direct marketing materials promoting services, products, facilities, or activities to you using information collected from you. You may choose to opt out of these direct marketing communications by using the unsubscribe function embedded in any direct marketing communication sent to you. Legend will never sell your personal information to any third party for marketing purposes.
Legend will retain your personal information throughout our relationship with you and for a period of time thereafter, in order for us to comply with our legal retention obligations.
Legend implements strict security measures aimed at ensuring the safety, integrity and confidentiality of your personal information. In the unlikely event of a system breach impacting your personal information, Legend will act in accordance with its legal obligations where it comes to notifying you and any relevant authority.
Under the applicable laws of your country or state, you may have certain rights relating to the use of personal information, such as:
To request a copy of the personal information held about you;
To request a transfer of your personal information, where applicable;
To object to the use or sharing of your personal information for certain purposes such as direct marketing; or
To request that we correct or delete your personal information.

You are entitled to exercise any applicable rights free from discrimination, which means that we will never discriminate against you or your use of the Legend services if you choose to exercise one of these rights.
